This Service Agreement governs access to and use of LinhBUIH websites, mobile applications, APIs, consulting deliverables, and related operational services. By accessing or using our services, you agree to this Agreement. If you use services on behalf of a company, you represent that you have authority to bind that company.
1. Services Covered
LinhBUIH provides enterprise-facing services for Europe and North America, including:
- Core enterprise operations support.
- Mobile management applications and related dashboards.
- Google Play and App Store application publication operations.
- Property, landscape, equipment, and cleaning task management applications.
- Construction industry consulting services.
- Online application full-industry consulting services.
2. Eligibility and Account Responsibility
- You must use the services lawfully and according to this Agreement.
- You are responsible for account credentials, administrative controls, and authorized access.
- You must provide accurate registration and contact information.
- You are responsible for actions performed under your account unless caused by our verified security breach.
3. Acceptable Use
You agree not to:
- Use the services for unlawful, deceptive, abusive, or infringing activities.
- Interfere with platform security, performance, or reliability.
- Attempt unauthorized access to data, systems, or APIs.
- Submit malicious code, spam, or harmful automation.
- Use services in violation of app store rules, advertising policies, export controls, or sanction laws.
4. Mobile Applications and App Store Distribution
Applications may be distributed through Google Play, Apple App Store, and other authorized channels. You agree to comply with all applicable platform terms and technical requirements, including updates related to app privacy disclosures, age ratings, content restrictions, subscription handling, and payment rules.
Platform providers may impose additional requirements. If such requirements conflict with this Agreement, mandatory platform and legal obligations prevail for the affected scope.
5. Advertising-Supported Features and Monetization Terms
Certain applications may include ad-supported components. Supported ad formats can include App Open (splash/open-screen style), Rewarded Video, Interstitial, and Banner formats.
Ad demand may be provided through one or more networks, including Google AdMob, Google Ad Manager, Meta Audience Network, AppLovin MAX, Unity Ads, ironSource, InMobi, Mintegral, Vungle/Liftoff, Pangle, Chartboost, Moloco, Amazon Publisher Services/TAM, and other approved partners.
- You must not use fraudulent traffic, invalid clicks, prohibited incentivization, or manipulative ad behavior.
- Monetization performance is variable and not guaranteed.
- You are responsible for market-specific disclosures and age gating where required by law.
- Ad and analytics settings may require jurisdiction-specific consent implementations.
6. Privacy, Data Processing, and Compliance
Use of services is also subject to our Privacy Policy. Where LinhBUIH processes personal data on behalf of enterprise customers, the customer acts as controller/business and LinhBUIH acts as processor/service provider for the relevant processing scope.
Both parties agree to comply with applicable privacy, cybersecurity, and consumer laws, including but not limited to GDPR, UK GDPR, CCPA/CPRA and related U.S. state laws, PIPEDA, LGPD, and other applicable frameworks in operating regions.
7. Children and Age-Restricted Contexts
- Services are intended for enterprise and professional use unless explicitly specified otherwise.
- If applications are made available in child-accessible contexts, age controls, content rating rules, and ad restrictions must be followed.
- Where COPPA, GDPR age-of-consent rules, or local child-protection laws apply, required safeguards must be implemented.
8. Customer Content and Data Ownership
You retain ownership of your content and business data submitted to the services. You grant LinhBUIH a limited license to host, process, transmit, and analyze such data solely to provide, secure, improve, and support services as permitted by contract and law.
9. Intellectual Property
All service software, documentation, visual assets, and operational methodologies provided by LinhBUIH are protected by applicable intellectual property laws. Except as expressly granted, no rights are transferred.
10. Service Availability and Changes
We aim for reliable service but do not guarantee uninterrupted availability. We may modify, improve, suspend, or discontinue features for security, legal, operational, or business reasons. We will provide commercially reasonable notice when material changes impact subscribed services.
11. Fees, Billing, and Payment
- Paid services, consulting scopes, or subscriptions are governed by applicable order forms or commercial terms.
- Fees are due according to agreed billing schedules.
- Late payment may result in service limitations or suspension after reasonable notice.
- Taxes are handled according to applicable law and contract allocations.
12. Third-Party Dependencies
Services may rely on cloud providers, app stores, ad networks, analytics platforms, and integration partners. LinhBUIH is not liable for outages or policy actions solely caused by third-party systems outside our reasonable control, provided we act with due diligence.
13. Security and Incident Management
We maintain technical and organizational safeguards to protect service environments. In case of confirmed incidents affecting customer data, we will follow our incident response process and provide required notifications under applicable law and contract terms.
14. Confidentiality
Each party agrees to protect confidential information of the other party using reasonable safeguards and to use such information only for the purposes of service delivery and lawful business cooperation.
15. Warranties and Disclaimers
Except as expressly stated in signed commercial terms, services are provided on an "as available" and "as is" basis. To the maximum extent permitted by law, LinhBUIH disclaims implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
16. Limitation of Liability
To the extent permitted by law, LinhBUIH is not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, goodwill, data, or business opportunity. Aggregate liability limits may be set in applicable commercial agreements.
17. Indemnification
You agree to indemnify and hold LinhBUIH harmless from claims arising from your unlawful use of services, violation of this Agreement, infringement, or misuse of data and third-party rights.
18. Suspension and Termination
We may suspend or terminate access for material breach, unlawful conduct, security risk, or non-payment after applicable notice where required. You may terminate according to contract terms. Upon termination, access ends and data handling follows contractual and legal retention/deletion requirements.
19. Export Control and Sanctions
You represent that your use of services complies with applicable export control and sanctions laws. You will not use services in prohibited jurisdictions or for prohibited end uses.
20. Governing Law and Dispute Resolution
Unless otherwise agreed in writing, disputes will be handled under the governing law and dispute process set out in the relevant commercial contract, order form, or mandatory applicable law. Consumer users may retain mandatory rights and forums where legally required.
21. Changes to This Agreement
We may update this Agreement to reflect service, legal, or business changes. Updated versions will be posted on this website with a revised effective date. Continued use after effective updates constitutes acceptance, except where law requires additional consent mechanisms.
